Terms of Service

1. Acceptance of Terms

By creating an account or using Birthday Mates ("the App"), you agree to these Terms of Service. If you do not agree, please do not use the App.

2. What Birthday Mates Is

Birthday Mates is an events and services platform. Users can purchase tickets to attend monthly in-person birthday hangout events in supported cities, book event-related services (such as the party space, photoshoots, videography, cakes, surprise gifts and the podcast studio), promote a business, and join our skill training. The App also includes the Vote of Influence, a free community vote: users are assigned to Group A or Group B based on their birthday and vote for their group, and Birthday Mate gives a birthday gift to the winning group's celebrant. Users can also apply to be the Face of the Month.

3. Eligibility

You must provide accurate registration information, including a real birthday, which determines your group assignment. Group assignment is final for each account and cannot be changed by request.

4. Voting

• Each user receives free votes periodically (e.g. through daily check-in or registration bonuses). Voting is free: votes cannot be purchased.
• Votes are non-refundable once cast.
• The platform may use simulated activity to keep the experience engaging, particularly in early months with limited real participation. Winners are always determined by genuine human votes only, simulated activity never decides who wins.
• We reserve the right to investigate and void votes obtained through fraud, automation, or abuse of the platform.

5. Wallet & Payments

• Wallet top-ups are processed via Paystack. Birthday Mates does not store your card details.
• Wallet funds may be used to purchase event tickets, service bookings, advertising and application or registration fees in the App.
• Wallet balances are non-transferable between accounts and are not redeemable for cash except at our discretion.
• Payments are final. See our Refund & Cancellation Policy for details, including what to do if you were charged by mistake.

6. Tickets, Events & Service Bookings

• Ticket prices are set by us and may be discounted for tickets booked ahead of the month of the hangout. The number of tickets may be capped by venue capacity.
• A ticket is for one specific hangout and is only valid at the door on that day. A ticket may be moved once, free of charge, to a later hangout, within the time limit shown in the App. It cannot be moved to an earlier hangout or after it has been used.
• Tickets are not refunded.
• Service bookings are paid for in full from your wallet when you book and are final. They cannot be cancelled or refunded.
• Birthday Mates reserves the right to reschedule or cancel an event due to circumstances beyond our control, with affected ticket holders notified and offered a reasonable resolution.

7. User-Generated Content

You are responsible for any profile photo, birthday message ("shoutout"), or other content you upload. Content must not be illegal, abusive, sexually explicit, or infringe on anyone else's rights. We reserve the right to remove any content, and suspend or terminate accounts, at our discretion.

8. Third-Party Sponsors

Birthday Mates may partner with third-party sponsors (such as Linksvert) who offer rewards or services to eligible users. Your relationship with any such sponsor, including registration and use of their services, is governed by that sponsor's own terms: Birthday Mates is not responsible for third-party sponsor services.

9. Account Termination

We may suspend or terminate your account for violation of these terms, fraudulent activity, or abusive behavior toward other users or staff.

10. Limitation of Liability

Birthday Mates is provided "as is." We are not liable for indirect, incidental, or consequential damages arising from your use of the App, to the maximum extent permitted by applicable law.

11. Changes to These Terms

We may update these terms from time to time. Continued use of the App after changes constitutes acceptance of the revised terms.
